  3. Creating Artificial Demand The SEC alleges Banister engaged in manipulative trading, including purchasing BioVie shares to create an 'artificial appearance of increased market demand.' These purchases were used to highlight 'recent increases in trading volume' to his audience.
  4. Misleading Touts Defendants touted the increased trading volume in BioVie stock, implying organic market interest. However, the complaint states these spikes were 'driven in significant part by Banister’s own purchases,' a fact he did not disclose.
